These Terms & Conditions (“Terms”) govern access to and use of PimplePlan, a behavioral skin-tracking and educational platform operated by PimplePlan LLC (“we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Accessing, creating an account for, or otherwise using the Service constitutes acceptance of these Terms and acknowledgment of the Privacy Policy.

If you accept on behalf of an organization, you represent that you have authority to bind that organization.

You must be at least 13 years of age to create an account or use the Service.

If you are under 18, a parent or legal guardian must review and consent to these Terms and the Privacy Policy before you use the Service, and must supervise that use as required by law.

You represent that you have the legal capacity to enter into these Terms in your jurisdiction, or that a parent or guardian has accepted them on your behalf where required.

PimplePlan provides tools that may include: behavioral skin tracking; habit and lifestyle logging; educational information; pattern summaries; optional AI-assisted features; optional photos; optional community or sharing features; and beta functionality.

Features may change, be added, limited, or removed at any time. We do not guarantee that any particular feature will remain available.

The Service is for personal tracking and education. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition.

PimplePlan is not a healthcare provider.

PimplePlan does not provide medical advice.

PimplePlan does not diagnose or treat medical conditions.

Use of the Service does not create a doctor–patient relationship.

You should consult qualified healthcare professionals for questions about your health, skin, medications, or treatment.

The Service must not be used for emergencies. In an emergency, contact local emergency services or seek immediate professional care.

AI-assisted outputs may be inaccurate, incomplete, or inappropriate for your situation.

Outputs are based partly on information you enter and on models that may change over time.

AI features are educational only and should not be used as the sole basis for medical or other important decisions.

AI-assisted suggestions are not prescriptions and are not personalized medical treatment.

You agree to provide accurate registration information and to keep it reasonably up to date.

You are responsible for maintaining the confidentiality of your credentials and for activity under your account.

Notify us promptly at contact@pimpleplan.com if you suspect unauthorized access.

We may limit accounts (including one account per person) where reasonably necessary to protect the Service or other users.

User Content includes logs, photos, written entries, community posts (when available), feedback, and similar materials you submit.

You retain ownership of your original User Content. We do not claim ownership of your photos or health-related entries.

You grant PimplePlan LLC a limited, worldwide, non-exclusive license to host, store, process, display, transmit, and otherwise use User Content solely as needed to operate, secure, improve, and provide the Service, subject to the Privacy Policy.

You represent that you have the rights needed to submit User Content and that it does not violate law or these Terms.

You agree not to: engage in illegal activity; harass or harm others; impersonate any person or entity; upload malware or malicious code; scrape the Service without permission; attempt unauthorized access; post harmful medical misinformation; share another person’s private information without authorization; use the platform to provide unlicensed medical care; or reverse engineer the Service except where such restriction is prohibited by applicable law.

We may investigate and take action, including removing content or suspending accounts, for violations.

This section applies only when community or sharing features are available.

We may moderate, remove, or restrict content or access that we reasonably believe violates these Terms, applicable law, or community standards, or that poses risk to users or the Service.

Community content reflects individual users and is not medical advice from PimplePlan.

Our Privacy Policy (available at /privacy) explains how we collect, use, and share information. Please review it carefully.

We do not claim compliance certifications (including HIPAA coverage as a healthcare provider) that have not been independently verified and approved for disclosure.

Paid subscriptions are not currently offered. If and when optional premium plans launch, this section will apply as updated.

Subscription plans, pricing, and included features will be shown clearly before purchase. Unless stated otherwise at checkout, paid plans renew automatically at the then-current rate until canceled.

You may cancel according to the instructions shown in-product or through the Apple App Store, Google Play, or other billing provider that processed your purchase. Cancellation generally stops future renewals; it does not automatically refund the current billing period unless required by law or store policy.

Any free trial will state its length and what happens when the trial ends. Unless you cancel before the trial ends, the subscription may convert to a paid plan if you provided a payment method.

Refund eligibility follows applicable law and the policies of the store or payment processor used. We do not promise refunds beyond those requirements.

Purchases made through the App Store or Google Play are also subject to Apple’s or Google’s terms and billing practices.

Beta features may contain bugs, change without notice, experience outages, produce incomplete results, or lose or reset test data.

We do not promise uninterrupted or error-free availability during beta.

Feedback you provide about beta features may be used to improve the Service as described in the Feedback section.

PimplePlan branding, software, interface, design, and original content belong to PimplePlan LLC or its licensors and are protected by applicable intellectual property laws.

These Terms do not transfer ownership of your User Content to us, except for the limited license described above.

The Service may rely on or link to third parties, including authentication providers, hosting, analytics, AI providers, health integrations, payment processors, and external websites.

Current infrastructure commonly includes Supabase for authentication and data storage, and cloud hosting for the web application. Additional processors (for example email/SMS, analytics, or AI providers) may be used as features launch and will be reflected in our Privacy Policy.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party practices except as required by law.

If you submit ideas, suggestions, or other voluntary feedback, you grant us permission to use that feedback to operate and improve the Service without obligation to compensate you, to the extent permitted by law.

We may suspend or terminate access if we reasonably believe you violated these Terms, pose a security or legal risk, or if required by law or operational necessity.

You may stop using the Service at any time. You may request account deletion via Account Settings or by contacting contact@pimpleplan.com.

Provisions that by their nature should survive (including disclaimers, limitation of liability, and intellectual property) will survive termination.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that insights or AI outputs will meet your expectations or be free from inaccuracy.

Nothing in these Terms is intended to exclude rights that cannot be limited under applicable law.

To the maximum extent permitted by applicable law, PimplePlan LLC and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid to PimplePlan for the Service in the twelve (12) months before the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain limitations; in those cases, the limitation applies only to the fullest extent permitted by law. Nothing in these Terms limits liability for gross negligence, willful misconduct, or other liability that cannot be limited under applicable law.

You agree to defend, indemnify, and hold harmless PimplePlan LLC and its personnel from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct or as limited by law.

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.

Subject to the arbitration terms below, exclusive venue for disputes that proceed in court is state or federal courts located in Dane County, Wisconsin, and you consent to personal jurisdiction there.

Except where prohibited by law, disputes may be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except where prohibited by law or where either party seeks injunctive relief for intellectual-property or unauthorized-access claims.

Class-action waiver: to the fullest extent permitted by law, disputes must be brought only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Informal dispute process: before filing a formal claim, you agree to email contact@pimpleplan.com with a brief description of the dispute and allow 30 days for us to attempt an informal resolution.

If any dispute-resolution provision is found unenforceable, the remaining Terms continue in effect to the fullest extent permitted by law.

We may update these Terms from time to time. Material changes will be communicated through the Service, email, or another reasonable method.

Continued use after the effective date of updated Terms constitutes acceptance, except where additional consent is required by law.
